You must be at least 18 years old, or the age of majority in your jurisdiction, to request an invite, join the waitlist, or create an account. If you are between 13 and the age of majority where you live, a parent or legal guardian must agree to these Terms and Conditions ("Terms") on your behalf and take responsibility for your use of StreamICan's distribution and The Pulse intelligence suite (together, the "Service"). By requesting an invite or otherwise using the Service, you agree to be bound by these Terms; if you do not agree, do not use the Service.
Our collection and use of personal information in connection with the Service is described in our Privacy Policy, which is incorporated into these Terms by reference.
We may change, modify, add to, or remove portions of these Terms at our discretion. We will post the updated Terms on this page and, where the change is material, notify you by email or through the Service. Continuing to use the Service after a change takes effect means you accept the revised Terms.
We grant you a limited, personal, non-transferable, and revocable right to access and use the StreamICan website and dashboard for your own artist or label business. You may not copy, reproduce, republish, scrape, mirror, or otherwise reuse any part of the site or its underlying software except as this permission allows.
The StreamICan name, the Pulse Momentum Score methodology, our software, dashboard designs, and all other site content are owned by or licensed to StreamICan and are protected by copyright, trademark, and other laws. Nothing in these Terms transfers any of that ownership to you; you receive only the limited license described above.
You retain all ownership rights to the recordings, compositions, artwork, and metadata you submit for distribution ("Your Content"). You grant StreamICan a worldwide, royalty-free, sublicensable license to reproduce, store, format, and deliver Your Content to digital service providers ("DSPs") and, where you have opted in, to feature Your Content in on-site promotion, solely to provide and market the Service. We may remove Your Content from the Service at our discretion, including where required by a DSP, a rights claim, or these Terms.
You represent that you own or control all necessary rights in Your Content, that distributing it through StreamICan will not infringe any third party's rights, and that Your Content and your use of the Service comply with all applicable laws.
The Pulse aggregates data about artists, including artists who are not StreamICan customers, from publicly available sources and licensed third-party data providers. Momentum Score and similar metrics are proprietary estimates provided for informational purposes only, and are not a guarantee of any streaming, playlist, or revenue outcome. We are not responsible for the accuracy of underlying third-party data we did not generate ourselves.
You are solely responsible for Your Content and for your conduct on the Service. We have no obligation to monitor releases, referrals, or waitlist submissions before they reach us, though we may review any of it at our discretion.
We may remove or decline to distribute any release, at any time, for any reason, including suspected rights issues, fraud, or a violation of these Terms, without liability to you for that removal.
You may not: distribute content you do not have the rights to release; attempt to manipulate streaming counts, playlist placements, Momentum Score, or royalty reporting through fraudulent or automated means; probe, scan, or attempt to breach the security of the Service; upload viruses or malicious code; impersonate another artist, label, or person; or use the Service in a way that violates any applicable law.
You are responsible for the accuracy of the information you submit and for keeping it current. We may access account information as reasonably necessary to operate the Service, enforce these Terms, or comply with the law. You may close your account at any time by contacting us.
You are solely responsible for keeping your password confidential and for all activity that occurs under your account. Notify us immediately at hello@streamican.com if you suspect unauthorized access.
If your tax residency changes, notify us within 30 days so we can update your royalty reporting and withholding accordingly.
StreamICan is not responsible for the actions, policies, or disputes of the DSPs, payment processors, or other third parties you interact with through the Service; those relationships are between you and the third party.
We may modify, suspend, or discontinue any part of the Service at any time, including individual Pulse features, without liability to you, though we will try to give notice of significant changes where practical.
If you send us feedback or suggestions about the Service, you agree we may use them without restriction or compensation to you.
Where our agreements with individual DSPs or payment processors impose additional requirements on how your content or funds are handled, those requirements apply alongside these Terms.
You may request removal of any release from any or all connected stores at any time at no cost; removal timing varies by store. We may suspend or terminate your account for violation of these Terms, fraudulent activity, or non-payment. You may close your account at any time; outstanding royalties owed to you will still be paid out.
You agree to indemnify and hold StreamICan harmless from any claim arising out of Your Content, your violation of these Terms, or your infringement of a third party's rights.
The Service is provided "as is" and "as available." StreamICan does not guarantee acceptance by any DSP, specific streaming performance, or any particular Momentum Score outcome, and disclaims all warranties, express or implied, to the maximum extent permitted by law.
To the maximum extent permitted by law, StreamICan's aggregate liability arising from these Terms or the Service will not exceed the greater of one hundred dollars ($100) or the fees you paid to StreamICan in the twelve months preceding the claim. Nothing in this section limits rights that cannot be excluded under the law of your jurisdiction.
We respond to properly submitted notices of alleged copyright infringement. If you believe your work has been distributed through StreamICan without authorization, contact our designated agent at hello@streamican.com with the information required to process a claim, and we will investigate and take appropriate action, which may include removal of the release in question.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles, and any dispute arising from them will be brought exclusively in the state or federal courts located in Delaware, except where applicable law requires otherwise.
These Terms are not transferable by you without our consent, and the sections concerning ownership, indemnification, disclaimers, and limitation of liability survive termination of your account. Questions about these Terms can be sent to hello@streamican.com.
